Terms of Use
The agreement between you and GymPilot: what the app does, what it does not do, how subscriptions work, and what you are responsible for when you train.
Last updated
GymPilot is a fitness product, not a medical one, and its programmes are generated automatically rather than reviewed by a trainer. Please read Health, safety and your responsibility when training before you start.
These terms
These Terms of Use govern your use of GymPilot Fitness — the GymPilot mobile app and this website (together, the “Service”). By creating an account or using the Service you agree to them. If you do not agree, do not use GymPilot.
The contracting legal entity and its registered address has not been finalised. This section is deliberately incomplete rather than filled with a placeholder that would misstate a binding term. It must be completed before these Terms are published.
Our Privacy Policy explains how we handle your personal data and forms part of these terms.
Eligibility
You must be at least 18 years old to create a GymPilot account. GymPilot is listed on Google Play for an audience of 18 and over and is not intended for children.
GymPilot does not verify your age. By creating an account you confirm that you meet this requirement. If we learn that an account belongs to someone under 18, we will delete it.
You must also be capable of entering into a binding agreement and not barred from using the Service under any applicable law.
Your account
You sign in with an email address and a password. You are responsible for:
- Keeping your password confidential and not sharing your account.
- Everything that happens under your account.
- Giving accurate information during onboarding — your programme and its suggested starting weights are built from what you tell us, so inaccurate figures produce a worse and potentially unsafe plan.
- Telling us promptly at info@gympilotfitness.com if you believe someone else has accessed your account.
What GymPilot provides
GymPilot gives you:
- A weekly training programme built around your goal, experience, schedule, training location, available equipment and the body areas you ask us to work around.
- Tools to log workouts set by set, including weight, repetitions and perceived effort.
- Your training history, progress charts and calculated personal records.
- A catalogue of exercises with written instructions and demonstration media.
- The ability to adapt, reschedule or regenerate your programme.
Programmes are general strength-training guidance produced from the information you provide. They are not personalised medical, clinical or rehabilitative advice, and they are not supervised coaching.
AI-generated programmes
GymPilot uses an AI model to assemble your programme from its exercise catalogue. You should understand three things about that.
- Plans are generated, not reviewed by a human. No trainer checks your programme before you see it.
- Output varies. Generating twice with the same answers may not produce the same programme.
- It can be wrong for you. A generated plan may suggest an exercise, a volume or a starting weight that is unsuitable for your body, your experience or your current condition, even when your inputs were accurate.
Exercises are constrained to the GymPilot catalogue and filtered by the equipment and limitations you select, and suggested starting weights are a conservative estimate rather than a tested maximum. Even so, you remain responsible for judging whether any exercise is appropriate for you, and for adjusting or skipping anything that is not. Fair-use limits apply to how often plans can be generated.
Health, safety and your responsibility when training
Strength training carries a real risk of injury. Consult a doctor or another qualified health professional before starting a new programme, particularly if you have an injury or medical condition, are pregnant or postpartum, are recovering from surgery or illness, or have not trained recently.
Stop immediately and seek medical attention if you feel chest pain, faintness, dizziness, or sharp or unusual pain.
GymPilot provides general fitness information. It does not provide medical advice, diagnosis or treatment, and nothing in it should be taken as such. It is not a substitute for professional supervision.
You are responsible for:
- Deciding whether you are fit to perform any exercise, and choosing weights within your ability.
- Using correct technique, appropriate progression and a safe environment and equipment.
- Using a spotter or safety equipment where appropriate.
- Stopping when something hurts. A programme is a suggestion, not an instruction.
The limitation areas you select help GymPilot avoid some exercises. They are a filter, not a clinical assessment, and they do not make a programme safe for a given injury.
Acceptable use
You agree not to:
- Use GymPilot for anything unlawful, or in breach of these terms.
- Share, sell or transfer your account, or use someone else’s.
- Attempt to access another user’s data, or any part of our systems you are not authorised to reach.
- Probe, scan or test the security of the Service, or interfere with its normal operation.
- Automate, scrape or bulk-extract the Service or its content, or circumvent the fair-use limits on plan generation.
- Copy, redistribute, publish or resell GymPilot’s exercise content, media or programmes.
- Reverse engineer or decompile the app, except where that right cannot lawfully be excluded.
- Upload or transmit anything malicious, or misrepresent who you are.
GymPilot Pro, billing and cancellation
Some features require a GymPilot Pro subscription, offered on monthly and annual terms.
Billing is by Google Play
Subscriptions bought in the Android app are sold and billed by Google Play using the payment method on your Google account. Google is the merchant of record. Prices, taxes and currency are shown at the point of purchase. GymPilot never receives your card details.
Automatic renewal
Subscriptions renew automatically at the end of each billing period until you cancel. Your Google account is charged for the next period within 24 hours of the current one ending, at the then-current price.
Cancelling
Cancel at any time in your Google Play subscription settings. Cancellation stops future renewals; Pro remains active until the end of the period you have already paid for. Cancelling in Google Play does not delete your GymPilot account, and deleting your GymPilot account does not cancel your subscription — you must do that through Google Play, or it will keep renewing.
Restoring purchases
If you reinstall GymPilot or sign in on another device, use the restore option in the app to re-link an existing subscription. Restoring works against the Google account that made the purchase.
Refunds
Because Google is the merchant of record, refunds are governed by Google Play’s refund policy and are requested through Google, not through GymPilot. We cannot process or guarantee a refund on Google’s behalf. Nothing here limits any statutory right to cancel or to a refund that you have under the law where you live.
Price and plan changes
We may change subscription pricing or what Pro includes. Changes to the price of an existing subscription take effect at the next renewal and only after any notice Google Play requires, giving you the chance to cancel first.
Intellectual property
GymPilot, its name, logo, software, exercise catalogue, written instructions, demonstration media and generated programme content are owned by us or our licensors and are protected by intellectual property law. Some exercise media is used under licence from third parties.
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for your own training while your account is active and, where a feature requires it, while your subscription is active. Nothing else is granted.
You keep ownership of the data you enter — your profile, your logged workouts and your body-weight entries. You grant us the licence needed to store and process it in order to run the Service for you, as described in the Privacy Policy.
Availability and changes to the Service
We aim to keep GymPilot available but do not guarantee uninterrupted or error-free operation. The Service depends on third parties — hosting, the AI provider, the app store — and may be unavailable during maintenance, outages or events outside our control.
We may add, change, suspend or remove features. If we discontinue a feature that is a material part of a paid subscription, we will give reasonable notice. We may also update these terms; if a change is material we will give notice in the app or by email before it takes effect, and continuing to use GymPilot afterwards means you accept it.
Termination and account deletion
You can stop using GymPilot at any time and delete your account yourself in the app, under Profile → Delete Account. If you no longer have the app or cannot sign in, email info@gympilotfitness.com from your account address with the subject GymPilot Account Deletion Request; we aim to complete verified emailed requests within 30 days. Either way deletion is permanent and cannot be undone. Full details are on the Delete your account page.
Deleting your account does not cancel a Google Play subscription, and does not by itself entitle you to a refund for a period already paid for. Cancel in Google Play first.
We may suspend or terminate your account if you breach these terms, particularly the acceptable-use section, or where required by law. Where it is reasonable to do so we will tell you why.
Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
We do not warrant that:
- The Service will be uninterrupted, secure or error-free.
- Any programme, suggested weight or calculated record is accurate, complete or appropriate for you.
- Using GymPilot will produce any particular fitness result.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profit, data, goodwill or anticipated savings, arising from your use of or inability to use the Service.
Our total aggregate liability arising out of or relating to the Service is limited to the greater of the amount you paid us for GymPilot in the twelve months before the event giving rise to the claim, or ten US dollars.
You accept the inherent risks of physical exercise. To the extent permitted by law, and subject to the paragraph below, we are not liable for injury or loss resulting from exercises you choose to perform.
Again, nothing in this section limits liability that cannot lawfully be limited, including for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation. Some jurisdictions do not allow these limitations, so they may not fully apply to you, and you may have rights under local consumer law that these terms cannot override.
Governing law and disputes
The governing law and the courts with jurisdiction over disputes has not been finalised. This section is deliberately incomplete rather than filled with a placeholder that would misstate a binding term. It must be completed before these Terms are published.
In the meantime, if you have a problem please contact us at info@gympilotfitness.com. We would much rather resolve something directly than formally, and your mandatory rights under the consumer law where you live are unaffected either way.
General
- These terms, together with the Privacy Policy, are the entire agreement between you and us about the Service.
- If any provision is found unenforceable, the rest stays in force and the provision is applied as closely as possible to its original intent.
- Not enforcing a term is not a waiver of it.
- You may not assign your rights under these terms. We may assign ours in connection with a merger, acquisition or sale of assets.
- Sections that by their nature should survive termination — intellectual property, disclaimers, limitation of liability and governing law — do survive.
